Information Collection and Use
If you are a Client, when you create an account to use the Services you will be directed to provide personal and, if relevant, company information such as: our company name, your name, email address, LinkedIn public profile URL (if available), and Twitter handle (if available), (collectively “Client Account Information”).
If you are the Talent, once you receive an invitation to use the Services, you will be directed to provide personal and, if relevant, company information to set up your account, such as: your name, email address, a description of skillset, type of project preference, portfolio website URL (if available), LinkedIn public profile URL (if available), Twitter handle (if available), GitHub public profile URL (if available), primary phone number, city (optional), and range of rates charged, (collectively “Talent Account Information”).
Clients are able to post website and mobile-based application development project requests on the Website, (“Projects”). Clients must provide the following information about their Project: a description of the project’s scope, skills required to complete the project, a timeline for completion of the project, budget, and a reference URL (if available), (collectively “Project Information”). Matchist will review the Project Information to (i) determine whether it fits the scope of the Services and (ii) if the Project is within the scope of the Services, to match the Client with Talent.
Once a Client has accepted a Match for an approved Project, these Users will work together create a Project Agreement. All of the information related to such Project Agreement is the “Project Agreement Information”. Matchist will use the Project Agreement Information to deliver the Services, for instance, to settle any disputes if a User who is a party to a Project Agreement requests Matchist Dispute Resolution.
We also collect “Non-Identifying Information” about you, which includes Aggregate Information, Public Information, and Usage Details. This is information that cannot reasonably be used to contact or identify you unless it is coupled with other information.
We may aggregate non-personal statistical information that does not individually identify you, such as information concerning, location or average usage (“Aggregate Information”). We collect this information directly, such as when you register and indirectly, such as when you use the Website or through our third-party service providers. The Aggregate Information we collect is pooled together to help us improve our Website and to deliver a better and more personalized service by enabling us to estimate our audience size and usage patterns; store information about your preferences, allowing us to customize our Website according to your individual interests; speed up your searches; and recognize you when you return to our Website.
Finally, we collect non-personal statistical information about your internet connection, the equipment that you use to access our Website and how you use our Website (“Usage Details”). This information is then pooled to allow us to optimize the Website to the internet connections and equipment that is used to visit the Website. We collect this information both directly from you when you provide it to us and automatically as you navigate through and interact with our Website, (i) including details of your visits to our Website, including traffic data, location data, logs and other communication data and the resources that you access and use on the Website and (ii) information about your computer and internet connection, including your IP address, operating system and browser type. The technologies we use for this automatic data collection may include:
Pixel Tags / Web Beacons. Pages of our Website and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit Matchist, for example, to count Users who have visited those pages or opened an e-mail and for other related Website statistics (for example, recording the popularity of certain Website content and verifying system and server integrity).
If we ever couple Non-Identifying Information with your Personal Information, the resulting information will become Personal Information.
Third-Party Service Providers
We use several third-party service providers in order to efficiently provide our Services to you. These services include such things as web hosting and credit card payment processing. Some third-party service providers will collect information directly from you and provide us with relevant data (such as credit card processing companies). We may use this information to carry out our obligations and enforce our rights arising from any contracts entered into between a User and Matchist or between a Client and Talent, including for billing and collection.
We may disclose Non-Identifying Information about our Users without restriction.
Public Information, such as your Peer Reviews, is information you ask us to broadcast publicly. We will only share this information with your express consent. Once your Public Information has been shared with the public, it may be searchable by search engines and be delivered to a wide range of users and services. When you share Public Information via the Services, you should think carefully about what you are making public.
We do not disclose your Personal Information except in the circumstances described here:
Your Consent: We may share or disclose your Personal Information at your direction in connection with your use of the Services. For instance, by using the Service, Clients and Talent ask us to share Client Account information, Talent Account Information, and Project Information with other Users in order to find the best professional match. When a Client posts a Project, Matchist will find the best Talent for the Project and send such Talent an invitation to opt-in to the Project. The invitation will include the Client’s Project Information and Matchist’s assessment of the Project. Once Matchist has identified the Matches, Matchist will provide such Matches with the Client Account Information. Matchist will provide to Client a list of the Talent who would like to opt-in for the Project, along with Talent Account Information and Peer Reviews for each such Talent. Once Users agree to work together, the Client and Talent will use the Services to create the Project Agreement, and such Project Agreement Information will only be available to the Talent and the Client working on that Project unless a party to such Project Agreement requests Matchist Dispute Resolution.
Service Providers: We may share or disclose your Personal Information to contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them. For instance, if a User chooses to use the arbitration services through Matchist Dispute Resolution, any User who is a party to such Project Agreement consents to Matchist sharing Personal Information with such arbitration service for the purpose of resolving the dispute on the Matchist Service.
Business Transfers: In the event that Matchist is involved in a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Matchist’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, your Personal Information held by Matchist may be among the assets transferred.
Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:
Email Communications. If you do not wish to have your e-mail address/contact information used by Matchist to promote our own or third parties' products or services, you can choose not to provide your e-mail address or you can opt-out by unsubscribing to the newsletter. This opt-out does not apply to information provided to Matchist as a result of a Project Agreement, payment processing or other transactions.
Accessing and Correcting Your Information
You may send us an e-mail email@example.com to request access to, correct or delete any Personal Information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
You may request that Matchist delete your account by contacting us at firstname.lastname@example.org. This request will delete your Talent or Client account. Matchist will not delete information that relates to you that is on another User’s account (for instance, a Project Agreement to which you are a party). If you believe information that relates you to on another User’s account is inaccurate, contact us at email@example.com.
Your California Privacy Rights
California Civil Code Section § 1798.83 permits Users that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an e-mail to firstname.lastname@example.org.
We recognize that you are providing sensitive information in connection with your use of the Services and that security is critical to our Services. As such, we take commercially reasonably security precautions, and will continue to vigilantly safeguard your sensitive Personal Information. We update our security software with the latest patches frequently. Our servers are maintained by a reputable third-party cloud-based PHP hosting service.
Children Under the Age of 13
Our Website is not intended for children under 13 years of age. No one under age 13 may provide any Personal Information on the Website. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on this Website or on or through any of the Services on the Website. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at email@example.com.
